Notice of the Passing of a Community Benefits Charge By-law by The Corporation of the Town of Whitby
Take Notice that the Council of The Corporation of the Town of Whitby passed Community Benefits Charge By-law # 8288-26 on May 25, 2026 under Section 37 of the Planning Act, R.S.O. 1990, c. P.13, as amended.
Community Benefits Charge By-law # 8288-26 will apply to all development or redevelopment that meets any individual criterion in the Planning Act. The community benefits charge will apply to eligible developments or redevelopment with buildings or structures containing five or more storeys and adding at least ten residential units. The community benefits charge is 4% of the value of land subject to development or redevelopment. The community benefits charge will contribute to Town-wide capital costs for Parking Services, Community Benefits Charge Administration, Culture & Tourism – Infrastructure, Equipment and Facilities, Roads and Related & Active Transportation, Public Hospital, Climate Change Initiatives, Town Facilities & Administration Buildings, Parkland, Park Development & Community Facilities, and Public Art, Heritage and Culture.

Appeal to the Ontario Land Tribunal (OLT)
Any person or public body may appeal to the Ontario Land Tribunal under Section 14 of the Development Charges Act and under Subsection 37(17) of the Planning Act, in respect of the Community Benefits Charge By-law. Appeals must be filed not later than 4:30 p.m. on Monday, July 6, 2026. Please see below for options to file a notice of appeal. The filing of an appeal, either electronically through the OLT e-file service, by email, by mail, or in-person after 4:30 p.m. on the date noted above will be deemed to have been received the next business day.
Appeals may be submitted by filing a notice of appeal with the Clerk of The Corporation of the Town of Whitby and making online payment of the applicable appeal fee via the OLT e-file service. First-time users will need to register for a My Ontario Account at https://olt.gov.on.ca/e-file-service/ and will select ‘Whitby (Town)’ as the Approval Authority for the appeal submission.
Alternatively, appeals may be submitted to the Clerk of The Corporation of the Town of Whitby by email to clerk@whitby.ca or by mail or in-person at 575 Rossland Road East, Whitby, ON L1N 2M8 using the appropriate OLT forms found at https://olt.gov.on.ca/about-olt. In addition to your notice of appeal, please ensure that you provide a certified cheque or money order for the applicable appeal fee, payable to the Minister of Finance. Your notice of appeal must set out the reasons for the appeal.

If there are no appeals filed within the appeal period, the by-law will come into effect as of the effective date indicated in the by-law (January 1, 2027).
