Current Whitby Official Plan Policy
The current Town of Whitby Official Plan permits accessory apartments. The following excerpt is the Official Plan policy related to accessory apartments:
220.127.116.11 Apartments in Houses
Apartments in houses shall be permitted in single detached and other attached ground related dwellings, in urban residential areas throughout the Municipality subject to the following criteria:
- one apartment unit per dwelling;
- one parking space per apartment;
- capacity of municipal sanitary sewer and water supply;
- structural suitability of the building to accommodate alterations for an additional dwelling unit; and
- compliance with the provisions of the Ontario Building Code, Fire Code, and all other relevant municipal and provincial standards.

Building an Accessory Apartment
Accessory Apartments are required to be registered in the Town of Whitby. Registration of an Accessory Apartment costs $250.00. This is a one-time fee; there may also be fees for inspections and building permit fees and required upgrades.
